DiCarlo acts in accordance with the provisions of the General Data Protection Law (“LGPD”) and other technical standards and normative provisions on the subject, providing information in a transparent and clear way about what we do with your personal data, so that you may be aware of the implications and of your rights.

Customer registration data are not disclosed to third parties, except when necessary for the delivery process, for billing, marketing actions or participation in promotions, upon acceptance by the customer at the time of registration. Your personal data is a fundamental part for your orders to arrive safely at your home, according to the stipulated delivery time.

DiCarlo is also concerned about the security of your data, and through this policy, we want to demonstrate that we have taken due care, using the best security mechanisms available to ensure the protection of your information.

Your rights

The General Data Protection Act (LGPD) gives the Customer the right to request from DiCarlo, at any time, upon formal request, information regarding the data processed.

In order for the Privacy Policy to be well understood, it is essential to clarify some important concepts:

Client:any individual who purchases products or services on the DiCarlo Store website;

personal data: any information related to a person that identifies him or that, used in combination with other processed information, identifies an individual. Also, any information through which it is possible to identify a person or to contact him.

Processing of personal data:processing of personal data the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, communication, transfer, dissemination or extraction of data from individuals.

Data holder:natural person whose personal data is processed by DiCarlo;

Need:the processing of personal data must be limited to the minimum necessary for the intended purpose. That is, it must be relevant, proportionate and not excessive.

Consent:clear and objective authorization that the holder gives for the processing of their personal data for a previously stipulated purpose. After giving consent, you can revoke it at any time. The revocation does not cancel the processing carried out previously.

It applies to all DiCarlo customers, including website, app and brick-and-mortar customers, who have in any way provided their personal data for treatment by DiCarlo.

DiCarlo collects and stores the following types of information:

Information you provide to us: DiCarlo collects Customer information in several ways: when you provide your CPF for issuance of the invoice; exchange some product; purchase one of the services offered by the website; create an account and provide data in “My Account”; place an order on our website or app; participate in the monthly draw; when you interact with the Customer Service; when participating in surveys or marketing promotions, etc. Among the information that may be requested are: full name, billing and delivery address, telephone numbers, email address, credit card details, CPF, RG and date of birth.

Information automatically collected by DiCarlo:we collect and store certain information whenever you interact with us. For example, we use cookies and obtain information when your browser accesses our website; when you click on advertisements, partner emails and other content provided by us on other websites.

• credit agencies or bodies (eg credit reports/checks);
• data providers (eg, demographic data related to online advertisements and Customer's interests).

Data is needed to:

- issue the Invoice;
- deliver the purchased products or the contracted service;
- optimize your interaction with us;
- guarantee the security of the website and the data it processes;
- inform the Client about the offers and publicize our services;
- comply with legal obligations;
- administrative and management purposes.

Providing the data allows:

- deliver the purchased products or services;
- carry out the process of exchanging or returning products, within the period established by the CDC (Consumer Defense Code);
- send updates on order status and service communications;
- coordinate with partners the delivery or availability of services;
- provide services suited to the Client's needs;
- improve customers' shopping experience with DiCarlo;

- keep the Customer informed about the products and services we offer;

- prevent, detect and investigate activities that are in disagreement with our Code of Conduct or that are prohibited or illegal;

DiCarlo uses legal bases, which may vary according to the purpose of collection, to process customer personal data. The storage period may change depending on the legal basis applicable to each situation and the purpose.

DiCarlo offers marketing services through free communications about offers, services and products to the Customer, related to their profile on the site and their purchase history. This service can be performed by sending emails, SMS and messages through the WhatsApp application. The Customer may cancel the sending of messages at any time by accessing the "My space" area.

With whom do we share your data?

The information collected will only be shared when necessary:

- for the adequate provision of the services object of its activities with partner companies, including carriers, means of payment companies and companies responsible for the provision of marketing services;

- protection in case of conflict;

- by means of a court decision or request from a competent administrative or judicial authority;

- with companies that provide technological and operational infrastructure, such as payment intermediary companies and information storage service providers.

How long do we store personal information?

We store customer data for as long as storage is necessary or relevant to achieve the stated purposes, under the terms of the General Data Protection Law.

What are the rights of the data subject?

From the beginning of the term of the LGPD, the holder of the personal data will have the right to obtain from DiCarlo, at any time, upon formal request, information regarding their personal data.

DiCarlo will have 15 days to respond to requests from personal data subjects. Requests will be analyzed as provided for in current legislation and, for legal reasons, some requests may not be met.

The Customer may request the deletion of any personal data described in this Privacy and Data Protection Policy. DiCarlo will use its best efforts to respond to all data deletion requests in the shortest possible time. However, the request for data deletion, complete or partial, may prevent the Customer from making new purchases. Even in the event of a data deletion request, DiCarlo will respect the minimum information storage period determined by Brazilian legislation, in particular, to comply with tax and legal obligations. In addition, some data may not be deleted as a result of a legal obligation to maintain it by DiCarlo or to comply with a court order or request from an administrative authority. Requests from the holders of personal data must be formalized by sending an email.

To maintain the security and protection of your personal data, provided at the time of registration, purchases or while using the website, under no circumstances should your login and password be shared with third parties. In addition, when accessing your account through "My Account", especially on public computers, make sure that you have logged out, to prevent unauthorized persons from accessing and using your information without your knowledge.

We do not ask for personal data by phone, WhatsApp, SMS or email. Under no circumstances should they be provided, so that an attempt at misuse is avoided.

Changes to the Privacy and Data Protection Policy.

DiCarlo may change this Privacy and Data Protection Policy at any time. Whenever any relevant condition of this Privacy and Data Protection Policy is changed, these changes will be valid, effective and binding after posting the new version on our website or sending the new version by email to the Customer.

We always value transparency:each time a material change is made, we will send you a notice indicating the new version in effect. By continuing to use our products and services after a change in the Privacy and Data Protection Policy, you are agreeing to the new conditions.

 Disclaimer of Warranties and Liability

DiCarlo will not be responsible for:

• errors or eventual inconsistencies in the transmission of data, the quality or availability of the Internet connection, which prevent the proper receipt of information by DiCarlo or the Customer;

• for the violation of any third party rights, including, without limitation, intellectual property rights, personality rights, confidentiality and secrecy related to any information or content entered on the platform by the Customer or under its responsibility;

• for damages or losses of any nature arising from the disclosure of confidential or confidential information made available by the Client through the website.

DiCarlo uses the best market practices to keep all data entered by the Customer on the website or informed by telephone safe. However, DiCarlo disclaims liability for damages of any nature that may arise from the knowledge that unauthorized third parties may have of any of the information passed on, as a result of failure exclusively attributable to the Customer or to malicious third parties who manage to access the data despite due care taken by DiCarlo.

Legislation and forum

This policy will be governed, interpreted and executed in accordance with the Laws of the Federative Republic of Brazil, especially Law No. of the Customer to resolve any doubts arising from this document.
